1. About these Terms
These Terms and Conditions apply to the website, consultations, memberships, coaching programs and related services supplied by Jacqueline Elizabeth Martinez, ABN 32 499 106 002, trading as Minimalist Strength (we, us or our).
By booking, applying for, purchasing or participating in our services, you agree to these Terms.
2. Our services
Minimalist Strength provides strength, fitness, mobility, lifestyle and related coaching services. Services may include consultations, assessments, personalised programming, coaching, education, check-ins, support and other inclusions described on our website or agreed with you.
The exact method, location, frequency and inclusions of the service will be those stated in your offer, booking confirmation or written agreement with us.
3. Eligibility and client responsibilities
You agree to:
- provide accurate and complete information;
- disclose injuries, medical conditions, symptoms, limitations, medications or other matters that may affect safe participation;
- notify us promptly if your health or circumstances change;
- follow reasonable safety instructions;
- use appropriate judgment and stop exercising if you experience pain, dizziness, unusual shortness of breath or concerning symptoms; and
- seek medical advice where appropriate.
We may require medical clearance before providing or continuing services.
4. Health and medical disclaimer
Our services are educational and coaching services and are not a substitute for medical diagnosis, treatment, physiotherapy or other healthcare.
We do not guarantee any particular health, fitness, body composition, performance or lifestyle outcome. Results vary between individuals and depend on factors including participation, consistency, health, nutrition, recovery and circumstances outside our control.
You remain responsible for deciding whether to participate and for seeking advice from a qualified health professional when appropriate.
5. Membership fees and minimum term
12-week coaching commitment, details discussed during your consultation.
Membership fees are confirmed with you in writing before you join, and the applicable fee is the one set out in your offer or written agreement with us.
Unless otherwise agreed in writing, payments are charged automatically each month using your nominated payment method.
You authorise us and our payment provider to process recurring payments in accordance with these Terms.
6. Automatic continuation after the minimum term
After the initial 12-week minimum term, the membership automatically continues on a month-to-month basis until cancelled in accordance with section 7.
The automatic continuation, recurring fee and cancellation process should be read carefully before joining.
7. Cancellation
You may not cancel for change of mind during the initial 12-week minimum term, except where required by law or where we agree otherwise in writing.
After completing the initial 12-week minimum term, you may cancel by giving at least 14 days’ written notice by email to contact@minimaliststrength.com.au.
Your membership will remain active until the end of the applicable paid billing period unless we agree otherwise. A cancellation request does not reverse a payment that was validly due or already processed before the cancellation took effect.
8. Refunds and consumer rights
Membership fees already paid are not refundable for change of mind, non-attendance, failure to use the service or a decision to stop participating.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where a service fails to meet a consumer guarantee, you may be entitled to a remedy required by law.
9. Failed or overdue payments
You must ensure that your payment details remain valid and that sufficient funds are available.
If a payment fails or becomes overdue, we may:
- retry the payment;
- ask you to update your payment method;
- suspend services until payment is made; and
- recover reasonable costs associated with unpaid amounts where permitted by law.
Suspension due to non-payment does not automatically cancel the membership or remove amounts already due.
10. Rescheduling and missed appointments
Appointments may be rescheduled subject to availability and any notice requirements communicated at the time of booking.
If you miss an appointment or provide insufficient notice, that appointment may be treated as used and may not be replaced or refunded, except where required by law or where we agree otherwise.
We may reschedule an appointment where reasonably necessary and will try to provide reasonable notice.
11. Changes to services or fees
We may make reasonable changes to service delivery, scheduling, systems, personnel or inclusions where necessary to operate or improve the service.
We will not increase the membership fee during the initial 12-week minimum term unless you agree. For an ongoing month-to-month membership, we may change the fee by giving reasonable advance written notice. You may cancel before the new fee takes effect by following the cancellation process.
12. Pauses
Membership pauses are not guaranteed and must be approved by us in writing. Any approved pause may be subject to conditions, dates and limits agreed at the time.
13. Intellectual property
All programs, written materials, videos, templates, systems, branding and other content supplied by us remain our intellectual property or that of our licensors.
We grant you a personal, limited, non-transferable right to use materials solely for your own participation in the service. You must not copy, share, sell, publish, distribute or commercially exploit them without written permission.
14. Acceptable conduct
You must not misuse our website, systems, content or communications, behave abusively or unlawfully, harass others, infringe intellectual property, interfere with service delivery or create a safety risk.
We may suspend or end services for serious or repeated misconduct, subject to applicable law.
15. Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
16. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of opportunity or loss caused by matters outside our reasonable control.
Where liability cannot lawfully be excluded but may be limited, our liability is limited to the extent permitted by law.
Nothing in this section excludes liability that cannot legally be excluded, including rights under the Australian Consumer Law.
17. Suspension or termination by us
We may suspend or terminate services where:
- payments are overdue;
- participation presents an unreasonable safety risk;
- you seriously or repeatedly breach these Terms;
- you engage in abusive, threatening or unlawful conduct; or
- we can no longer reasonably provide the service.
Where appropriate, we will provide notice and consider whether a refund or other adjustment is required by law.
18. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, including illness, emergencies, internet or platform outages, natural disasters, government action or service-provider disruption. We will take reasonable steps to minimise disruption.
19. Changes to these Terms
We may update these Terms from time to time. Changes will not retrospectively remove rights already accrued. Material changes affecting an ongoing membership will be notified within a reasonable time.
20. Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the courts and tribunals with jurisdiction in New South Wales and Australia.
